Estate Management and Will Wording

When creating or updating your Will, we suggest you consult a legal adviser to ensure that your Will is valid and that your wishes are expressed correct. If you do not have a solicitor, there are several ways you can include a gift to Adelaide Festival Centre Foundation in your Will:

  1. Write your Will online. To assist our donors in writing their wills, we have partnered with the team at Gathered Here, Australia’s top-rated free online Wills platform.
  2. If you do not have a Will, you can consult the Law Institute of South Australia to find a solicitor in your area who specialises in Wills and Estates.
  3. If you already have a Will and would like to include a gift, add a codicil – a short legal amendment to your will, which your solicitor will be able to assist you with.

It’s important to use the correct wording and legal names when making a gift in your Will to ensure that it can be used as you intended. The Adelaide Festival Centre Foundation recommends the following wording in consultation with your legal advisers when drafting your Will:

Unrestricted Bequest

I give (the sum of $___/ or ____%/ residue of my estate/personal property/real estate/shares) to Adelaide Festival Centre Foundation Incorporated (ABN 12 929 134 938), and I declare that the receipt of the authorised officer of the Foundation for the gift shall be sufficient discharge to my executor/trustees.

Bequest for a Specific Purpose

I give (the sum of $___/ or ____%/ residue of my estate/personal property/real estate/shares) to Adelaide Festival Centre Foundation Incorporated (ABN 12 929 134 938), to be applied to …………………………………………….. and I declare that the receipt of the authorised officer of the Foundation for the gift shall be sufficient discharge to my executor/trustees. If the specific purpose is no longer valid at the time of my death then the bequest may be used for a general purpose the Foundation determines to most closely align with the stated purpose.

If you are creating a Will or updating it, we suggest you consult a legal adviser to ensure that your Will is valid and your wishes are expressed correctly. It may be helpful to your legal adviser, State or Public Trustee or Trustee Company to have reference to our suggested wording above when updating your Will. If you do not have a solicitor, you can consult the Law Institute of South Australia to find a solicitor in your area who specialises in Wills and Estates.
